Trump's Framework of Punishment and Favor

Donald Trump's voracious urge for payback has rapidly evolved into a structured framework. Within the past year, the leader's anger and caprices have assumed the guise of government actions in ways analogous to earlier repressive regimes. Justice department officials who fail to comply are summarily removed and replaced by supporters. Opposing leaders who confront him face legal action, court proceedings and sanctions. Critics have been labeled under administration memoranda as “unpatriotic”, “opposed to religious values” and “opposing economic freedom”, and menaced with criminal charges as “extremists”.

The Justice System Restructured

All case involving legal action of Trump's enemies and leniency for his allies demonstrates its own unique characteristics. However, notwithstanding their particular nature, they exemplify expressions of what has emerged as a calculated technique. Such events are far from random. His removal of DoJ prosecutors and law enforcement agents, coupled with his installation of supporters in senior positions, commenced quickly, promptly took on a pattern, and has now been formed into a structure. Federal prosecutors and the law enforcement agency have been transformed into partisan bodies under his explicit command to carry out his wishes. Wrongdoing has been rendered normal. It represents the system of punishment.

Leadership is focused with punishing the leader's supposed enemies than they are with protecting our public welfare.

Within the System

The origin of this system has been exposed in the lawsuit of three previous high-ranking FBI executives lodged in the ninth month in the judicial system in the capital against top official Kash Patel and attorney general another official for unlawful firing in “a effort of payback against them for what Defendants deemed to be a failure to exhibit proper political loyalty”. According to the filing that one official, the ex- interim leader, describes a conversation in which Patel “freely acknowledged the illegality of his behavior”.

The official had tried to defend FBI agents from being fired, the lawsuit alleges. Patel advised him that “they” – interpreted by Driscoll to be the presidential administration and justice department – had instructed him to remove everyone who they identified as having been involved in a criminal investigation against him. The complaint adds: “Patel stated that he had to fire the individuals his superiors told him to dismiss, because his chance to hold his own job relied on the ouster of the personnel who were involved in matters involving the President. Patel commented that there was no way he or Driscoll could do to prevent these or any other terminations, because ‘the bureau sought to put the President in prison and he hasn't forgotten it.’” After Driscoll informed the director he was disregarding the agency's own policies, the director allegedly said “he recognized that and he realized the essence of the swift terminations were probably unlawful”.

Broad Impact

Following his alleged confession to him, the DoJ and the law enforcement agency have been gutted and redirected for Trump's system of punishment. Six of the bureau's high-ranking agents were fired or compelled to leave in the early weeks of the government. Approximately 4,500 lawyers at the department have accepted a “deferred resignation program”. At least multiple government attorneys, such as those in the Manhattan division, resigned in dissent over what they regarded as political interference in dropping the criminal prosecution against the local official, a political figure, in return for his cooperation with Trump's ICE arrests of immigrants. The public integrity section of the justice department, which oversees misconduct investigations, has been reduced to minimal staff. The rights protection unit has been decimated: 70% of its personnel has departed. 33% of executives at the justice department have quit. The section enforcing conservation statutes has seen departures of a majority its leadership.

Favors and Penalties

Concerning the Adams case, the interim prosecutor for the southern district of New York, the official, stepped down in dissent against what she labeled as the “exchange”. The border official, his “border czar,” showed up as the agent with him on a media outlet to state: “Unless he complies, I'll be back in NYC.”. And, another figure, earlier the senior DoJ official and a former Trump attorney, who arranged the deal, was awarded an court role, a likely stepping stone to the supreme court.

His immunity for offenses perpetrated while in power, awarded by the unprecedented ruling of the conservative on the highest court, thus preventing his legal action over the January 6 insurrection and preserving his electoral prospects for the national vote, is the foundation stone on which he stands to defend his supporters. Under these circumstances, he has been empowered to authorize corruption. The impact of the judicial ruling infuses his administration and the GOP completely. The legal case has metastasized. As Richard Nixon's White House counsel he said about the Watergate
